easyCar Pool is operated by Lowcost Vehicle Rental (UK) Limited (trading as easyCar), with company registration number 03816836 and its registered address at 3rd Floor Rear, Satila House, 109-111 Farringdon Road, London, EC1R 3BW ("easyCar"/"we"/"our"/"us")

easyCar Pool connects drivers travelling on a publicised route with passengers who are seeking to travel on some or all of the same route in order to enable them to share the journey and, if they agree to do so, some of the associated costs. We do this by providing an online platform that provides a way to organise bookings and payments (our "Services"). The online platform is available via the easyCar website (and its sub-domains, together the "Site").

By registering as a user of the Services, via the Site, you agree to comply with and be legally bound by these terms and conditions of service ("Terms").

These Terms constitute a binding legal agreement between you and easyCar. Please also read our Privacy Policy carefully. If you do not agree to these Terms or our Privacy Policy, you may not use the Services.

The Services provided through the Site allow Drivers (as defined below) to create a listing for one or more Journeys and allow Passengers (as defined below) to find out information about what Journeys are available to share and to make a booking directly with Drivers.

easyCar acts as a broker to facilitate the sharing of Journeys (as defined below) by Drivers with Passengers. easyCar provides a way to organise bookings and payments for these arrangements. easyCar does not provide taxi or private driver services and, unless otherwise expressly stated, easyCar does not own or maintain any vehicles for this purpose. The contract for the sharing of the Journey is between the Driver and the Passenger. easyCar is not a party to that contract or responsible in any way for its performance or non-performance.

  1. INTRODUCTION

    1. For the purpose of these Terms, the following words have the meaning set out below:
      Account a registered account of a Member.
      Administration Charge the fee payable by a Passenger for a Booking cancelled in accordance with clause 10.4.
      Booking an agreement between a Driver and a Passenger made via the Site (which is made when a Driver accepts or confirms a Booking Request) for the Passenger to occupy a seat in the Driver’s vehicle in return for the Driver Payment, in accordance with these Terms.
      Booking Confirmation a confirmation issued by easyCar via the Site once a Driver has accepted or confirmed a Booking Request.
      Booking Fee the total fee payable by the Passenger for a Booking, calculated by adding the Driver Fee and the Transaction Fee.
      Booking Request a request by a Passenger to join a particular Journey, submitted via the Site.
      Chargeback Administration Charge a charge payable by a Member in the circumstances set out in clause 8.4, in the amount set out in the Schedule of Charges.
      Driver a Member who signs up to make a Journey or Journeys available to book via the Site.
      Driver Fee the price per seat that the Passenger pays for a Journey. This shall be calculated using the price per mile set by the Driver in accordance with clause 3.3 below.
      Driver Payment the payment due to the Driver which shall be the applicable Driver Fee for the relevant Journey less the Transaction Commission.
      Journey a vehicle journey offered by a Driver on the Site between two points at a specified time, which (where relevant) is the subject of and may be amended by a Booking.
      Journey Start Time the date and time of the Driver's departure to commence the Journey, as posted by the Driver on the Site
      Member an individual who signs up for and is accepted for membership of easyCar Pool through the sign up process on the Site, including Drivers and Passengers.
      Member Content all text, graphics, photographs, images, information or other materials that a Member uploads to the Site or otherwise transmits to easyCar.
      Membership Criteria the criteria for membership of the easyCar Pool as specified by easyCar on the Site and as amended from time to time.
      Passenger a Member who requests and books a Journey from a Driver via the Site.
      Service Fee the Transaction Fee plus the Transaction Commission (including VAT).
      Transaction Commission a charge of 12% of the Driver Fee, including VAT.
      Transaction Fee a charge of £1.00 per Booking, including VAT, payable by the relevant Passenger to easyCar (for the use of the Service), which forms part of the overall Booking Fee.
      Other capitalised terms used in these Terms have the meanings set out alongside them.
    2. The Services provided through the Site allow (a) Drivers to create a listing for their Journeys and (b) Passengers to find out information about Journeys that are available to be booked and to make Bookings directly with Drivers. Passengers may also post details of trips that they would like to take to be matched with Journeys that are subsequently posted.
    3. It is important to note that easyCar is not a party to the agreement between the Driver and the Passenger in relation to any Booking, and easyCar does not have any control over, and is not responsible for, the actions or conduct of either the Driver or the Passenger. By agreeing to be bound by these Terms, you accept and agree this. If you do not, then you may not use the Services.
    4. Unless otherwise stated as applying only to Drivers or Passengers, these Terms shall apply to all Members.
    5. easyCar reserves the right to update these Terms at any time. If easyCar amends the Terms it will inform you of any changes, including by publishing the amended version on the Site, and such amended version will govern the relationship between easyCar and its Members. Your continued use of the Services shall indicate your agreement to be bound by the amended Terms.
    6. Members should direct any questions, complaints or comments regarding the Services subject to these Terms to carpool@easycar.com.
  2. REGISTRATION & MEMBERSHIP

    1. Anyone may apply to be a Member of easyCar Pool provided that they meet the relevant Membership Criteria.
    2. Once accepted into easyCar Pool, each Member must keep his or her contact details up to date through the Site. Any mobile phone number and email address provided must be personal to, and readily accessible by, such Member. Each Member must respond promptly to requests by easyCar for updates to any information provided to easyCar. Each Member must inform easyCar immediately if he or she no longer meets the Membership Criteria.
    3. All Members must cooperate with and assist easyCar in good faith (including responding promptly to communications). All Members must provide easyCar with such information and take such actions as may be reasonably requested by easyCar in connection with any complaints, claims, charges or notices relating to Bookings, or with respect to any investigation undertaken by easyCar or its representatives, its insurers or the police, whether regarding any insurance claims, accidents or driving offences connected to any Booking, any use or abuse of the Site or any other investigations.
    4. Any application for membership which references a promotional offer acknowledges and accepts the terms and conditions of such a promotional offer as set out on the Site in addition to these Terms.
  3. POSTING A JOURNEY

    1. Drivers may make their Journeys available using the Site, specifying the route, journey timing, preferences and pricing in accordance with the procedures set out on the Site.
    2. The Driver must, at the time of the Journey:
      1. be legally in possession of the vehicle in which the Journey is undertaken;
      2. hold a valid, current driving licence and valid, current insurance covering the vehicle and third party liabilities;
      3. ensure that the vehicle is in roadworthy condition;
      4. be the intended driver for the entirety of the Journey; and
      5. use a vehicle with 4 wheels (excluding any spare wheel) and a maximum of 7 seats, and the Driver should not post a Journey if at the time of doing so he or she is aware that he or she will not be able to satisfy all these conditions.
    3. Driver may elect to propose the price per seat per mile for the Journey suggested by easyCar or vary the price within parameters set by easyCar as set out below and on the Site. As a Driver you acknowledge that it is not permitted to profit from using the Site and that payments from Passengers are intended only to cover a reasonable share of the costs of a Journey. Failure to comply with this restriction may result in your insurance policy becoming invalid or void (and easyCar expressly disclaims any liability for such an occurrence as a result of use of the Site in contravention of these Terms in general and this clause 3.3 in particular). Drivers should, in any event, check the terms of their insurance policy to ensure that it covers the use of the relevant vehicle in the manner envisaged by these Terms.

    4. Applied prices will vary according to the proportion of the overall Journey length undertaken by each Passenger.
  4. BOOKING

    1. Passengers may request to book a seat or seats on a Journey using the Site by making a Booking Request. The Passenger may also request a partial Journey where the start and/or end points of the Passenger’s desired journey are within the specified Journey. The Driver Fee shall at all times be calculated based on the actual Journey undertaken.
    2. Drivers may choose the option either to (a) accept or decline each separate Booking Request individually (known as "Available on Request"), or (b) choose to allow all Booking Requests to be immediately confirmed when a seat is available, without requiring a response (known as "Instant Book").
    3. Once a Booking Request has been accepted or confirmed in accordance with clause 4.2 above it is binding on both the Driver and Passenger, subject to the cancellation rules set out in these Terms. Upon acceptance or confirmation of a Booking Request in accordance with clause 4.2, a Booking Confirmation will be issued by email through the Site.
    4. A Passenger may cancel a Booking Request without charge or penalty at any time before the Driver accepts or confirms the Booking Request by withdrawing the Booking Request. If a Passenger wishes to cancel a Booking Request after then, the cancellation provisions set out in clause 10 of these Terms will apply.
    5. When making a Booking, the Passenger should rely solely on the information provided by the Driver on the Site, and any additional information communicated to the Passenger directly by the Driver. easyCar may endeavour to provide additional information about the Journey upon request from the Passenger, but will not assume any liability for the accuracy or completeness of any such information.
    6. The Driver, not easyCar, is solely responsible for honouring any accepted or confirmed Booking Requests.
  5. MEMBERS’ RESPONSIBILITIES

    1. Each Member is solely responsible for observing all laws, regulations and obligations applicable to their use of the Site and Service.
    2. Each Member undertakes:
      1. not to use the Service for professional, commercial or profit-making purposes;
      2. not to send easyCar (including upon creation or updating of that Member's account or a transaction whereby a Passenger requests a seat or seats on a Journey and the Driver accepts) or the other Members any false, misleading, malicious or fraudulent information;
      3. not to speak or behave in any way or post any content on the Site of a defamatory, injurious, obscene, pornographic, vulgar, offensive, aggressive, uncalled-for, violent, threatening, harassing, racist or xenophobic nature, or with sexual connotations, inciting violence, discrimination or hatred, encouraging activities or the use of illegal substances, or more generally contrary to the purposes of the Service, or that may infringe the rights of easyCar or a third party or contrary to good morals;
      4. not to infringe the rights and image of easyCar, including its intellectual property rights;
      5. not to open more than one Account on the Site and not to open an Account in the name of a third party;
      6. not to try to bypass the online booking system of the Site, including by trying to send another Member or exchanging with another Member contact details in order to make the booking outside of the Service and avoid paying the Service Fees;
      7. not to contact another Member via the Site (or through any personal data obtained through the Site) for a purpose other than confirming or changing the terms or nature of a Journey or a Booking;
      8. not to accept or make payment relating to a Booking or the posting of a Journey outside of the Service; and
      9. to comply at all times with these Terms and the Privacy Policy.
  6. RESPONSIBILITIES OF THE DRIVER

    1. The Driver undertakes to meet any Passengers for booked Journeys at the agreed pick-up point at the agreed time.
    2. In the event of a delay in reaching a pick-up point the Driver must use his or her best efforts to contact any affected Passenger.
    3. The Driver must ensure that, at the start of and (where applicable) for the duration of each Journey:
      1. the vehicle being used has a valid MOT certificate (if applicable) and is roadworthy and serviceable, complying with standards stipulated by law;
      2. all relevant vehicle taxes are paid and any other statutory requirements for use of a vehicle on public roads in the intended territories are met;
      3. they are in possession of a valid, current driving licence;
      4. they are in good health with no known medical conditions that could put a passenger at risk; and
      5. they are not under the influence of alcohol, drugs or any other substance that might impair their ability to drive.
    4. It is a Driver's responsibility under UK law to ensure that the vehicle is roadworthy. Accordingly the Driver shall ensure that as a minimum:
      1. tyres all have adequate tread depth and are not worn;
      2. the handbrake works;
      3. engine noise is not excessive or unusual;
      4. electric windows work;
      5. mirrors adjust;
      6. side mirrors are free from cracks;
      7. seats adjust;
      8. seat belts are present and work;
      9. headlights, indicators, brake lights and reversing lights work;
      10. washer fluid is present.
    5. The Driver further undertakes to:
      1. follow the Journey route advertised as closely as is reasonable;
      2. provide evidence of his/her driving licence, vehicle registration documents, vehicle taxation documents and insurance documents if requested by a Passenger and/or easyCar;
      3. use reasonable efforts to ensure they are contactable by Passengers in the hour before the scheduled pick-up;
      4. (if the Journey involves the crossing of any international border) hold and make available on request to the Passenger and any competent authority any necessary documentation required to cross any relevant international borders as part of the Journey such as a valid passport (and visa if required); and
      5. not decline any Booking Request on the basis of race, gender, ethnicity, national origin, sexual orientation, marital status, disability or any other grounds which would contravene applicable laws.
  7. REPONSIBILITIES OF THE PASSENGER

    1. The Passenger shall:
      1. adopt appropriate behaviour during the Journey so as not to hinder the concentration or driving of the Driver or the peace and quiet of the other Passengers;
      2. respect the Driver’s vehicle and its cleanliness;
      3. in the event of a delay in reaching the agreed pick-up point, inform the Driver without delay;
      4. not carry during a Journey any item, goods, substance or animal that could hinder the driving and concentration of the Driver, or the nature, possession or carriage of which is contrary to applicable law;
      5. (if the Journey involves the crossing of any international border) hold and make available on request to the Driver and any competent authority any necessary documentation required to cross any international borders en route such as a valid passport (and visa if required);
      6. use reasonable efforts to ensure they are contactable by the Driver in the hour before the scheduled pick-up; and
      7. not at any time during a Journey be under the influence of drugs, alcohol or any illegal substance.
  8. CHARGES AND PAYMENT

    1. The Passenger shall pay the Booking Fee upon acceptance or confirmation of a Booking Request. The Booking Fee shall comprise:
      1. the Transaction Fee; and
      2. the Driver Fee.
    2. easyCar collects the Driver Payment from the Passenger on behalf of the Driver. easyCar shall be entitled to deduct the Transaction Commission from the Driver Fee before paying the balance (that is, the Driver Payment) to the Driver.
    3. Each Driver hereby appoints easyCar as that Driver's authorised payment collection agent solely for the purpose of accepting the Driver Fee and any other charges payable by the Passenger to the Driver in accordance with these Terms. In relation to each completed Booking, easyCar will (subject to clause 8.5) pay to the Driver the applicable Driver Payment within 14 working days of the end of the Journey, to the bank account nominated by the Driver.
    4. The Passenger will be liable to a chargeback administration charge if he or she applies for a debit or credit card chargeback claim without reasonable cause. This charge will cover any chargeback fees, administrative and dispute costs actually incurred by easyCar as a result of such claim.
    5. The Driver accepts that easyCar's obligation to pay the Driver any sums payable under a Booking (including any payment under clause 8.3) is conditional upon actual receipt by easyCar of the associated payments from the Passenger that is the subject of the Booking.
    6. The Driver acknowledges and agrees that easyCar may, without limiting any other rights or remedies that easyCar may have, set off any amounts received from the Passenger in respect of any Booking, against any amounts payable by the Driver to either easyCar or to the Passenger, pursuant to these Terms.
    7. The Driver acknowledges and agrees that the Driver is solely responsible for determining any personal tax liability as a result of the receipt of any income as a result of sharing a Journey under these Terms, and for any applicable tax reporting requirements. easyCar does not provide or offer any tax–related advice to Members.
  9. PERSONAL INFORMATION

    1. easyCar will hold and use a Member's personal information in order to perform and improve the Services. easyCar may also make a Member's personal information available to easyCar's group companies for business administration purposes in accordance with the Privacy Policy.
    2. easyCar may also use a Member's personal information to search the files of credit reference agencies, who will record this search. This information will be used only to help make credit reference decisions or, occasionally, for fraud prevention or tracing debtors. easyCar may also share a Member’s personal information with the providers of commercially available databases where necessary to assist with the validation of the information provided by the Member during his or her membership and at all times in accordance with the Privacy Policy .
    3. easyCar may share a Member's personal details with the police or other law enforcement authorities in response to reasonable requests (as determined by easyCar in its sole discretion) or if compelled to do so by a court or other competent authority.
    4. Each Member explicitly consents to having his or her personal details, including details of any relevant criminal offences or alleged criminal offences, transferred to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors, insurance underwriters, and the British Vehicle Rental and Leasing Association (BVRLA), in the event that such Member breaches any of the conditions of these Terms.
    5. Further information about how easyCar uses a Member's personal information is set out in the Privacy Policy.
    6. Members will be required to share certain of their personal information with other Members in the course of making enquiries and arranging Bookings. Each Member acknowledges and agrees that he or she shall use the information received from other Members only for these purposes and shall take all reasonable measures to keep such information confidential. easyCar will not be liable for any misuse of information shared between Members.
  10. CANCELLATION AND AMENDMENT

    1. Once a Booking Request has been accepted by a Driver, the Passenger may not cancel the relevant Booking without the express agreement of the other party (at that party's sole discretion), except in the circumstances set out in clauses 10.3 or 10.4.
    2. A Driver may cancel a Booking at any time by notifying both easyCar and the Passenger via the Site, and in such cases the Passenger will be due a full refund of the Booking Fee.
    3. A Passenger may cancel a Booking in the following circumstances by notifying both easyCar and the Driver, and in such cases will be liable to pay the following cancellation charges:
      1. where the notification is received more than 24 hours before the Journey Start Time, a cancellation charge equivalent to the Service Fee;
      2. where the notification is received between 24 hours and immediately before the Journey Start Time, with a charge of Service Fee plus 50% of the Driver Payment;
      3. where the notification is received after the Journey Start Time, at full cost of the Booking Fee. Note that if a Passenger has not arrived at the pick-up point within 15 minutes after the agreed pick-up time they will forfeit the full Booking Fee.
    4. In the event of unforeseeable circumstances beyond the reasonable control of either the Passenger or the Driver, or other extenuating circumstances, that materially impact on the ability to complete a Journey, including:
      1. serious illness of the Driver, such that the Driver is unfit to drive;
      2. breakdown of the Driver's car part way through a journey;
      3. termination or suspension of a membership in accordance with clause 11.3 below;
      4. natural disaster (including but not limited to fire and flood);
      5. acts or restraints of governments or public authorities; or
      6. war, riot, civil commotion or acts of terrorism,
      the Driver and Passenger authorise easyCar, at its sole discretion, to decide whether it is appropriate to cancel a Booking and offer the Passenger a refund of the Driver Payment less an Administration Charge. Each Member acknowledges and agrees that easyCar will not have any liability to any Member for such cancellations and refunds. Supporting documents may be required by easyCar before such a refund is granted.
    5. If a Driver or Passenger wishes to amend a Booking (including the length of a Journey), he or she must agree the amendment with the other party, and contact easyCar if a change in pricing is agreed (provided always that any agreed pricing changes must still comply with clause 3.3).
    6. Each Member accepts that easyCar's obligation to pay any cancellation or other charges in respect of cancellation, is conditional upon successful receipt of the associated payments from the other relevant Member.
  11. TERMINATION AND EFFECTS

    1. Subject to clause 11.2, a Member may cancel his or her membership by giving notice in writing to easyCar at any time.
    2. Cancellation of a membership shall be deemed to be a cancellation of any Booking by that Member which has not been completed at that time, and clause 10.2 or 10.3 shall apply as appropriate.
    3. easyCar may suspend or terminate a Member's membership and/or access to the Site at any time in its discretion with or without prior notice or cause, and without liability to that Member. In this event the provisions of clause 10.4 above will apply to any Booking.
    4. Termination of membership will not affect the right of easyCar to recover from a Member any money owed pursuant to these Terms. Where a Member cancels his or her membership, easyCar will not be obliged to delete or return to the Member any Member Content he or she has posted to the Site, including any reviews or feedback.
  12. LIMITATION OF LIABILITY

    1. The Member Content published or displayed by Members on the Site is provided without any guarantees, conditions, representations or warranties by or on behalf of easyCar as to its accuracy or completeness and is provided on an "as is" basis. easyCar does not endorse any Member or any Journey. Images of vehicles on the Site are indicative only. Images may be those of the relevant Driver, and indicate a photographic representation of the vehicle at the time the photograph was taken. easyCar does not verify the accuracy of any images. No additional information should be inferred from the other contents of the image. Where no photograph is available, stock images of vehicles may be used.
    2. easyCar does not make any representations or warranties about, confirm, endorse or recommend any Member or the Member's identity, background, or driving ability or experience. The Member's appearance on, or use of, the Site should not be taken as any such endorsement or recommendation.
    3. easyCar shall not be liable (whether in contract, tort or otherwise) for any failure of a Member to perform his or her obligations in relation to any Booking. To the extent permitted by law, easyCar hereby expressly excludes all conditions, warranties, representations and other terms which might otherwise be implied by any law, regulation, statute, common law or law of equity.
    4. As a Member, you agree that you shall take sole responsibility for all activities or actions under your Member Account and that you shall not disclose your password or login details to any third party. Members must notify easyCar immediately if they believe that any unauthorised activities or actions have taken place in relation to their Account.
    5. To the fullest extent permitted by applicable laws, easyCar disclaims responsibility for any harm resulting from a Member's use of any part of the Site or the Services (including but not limited to any harm arising from any Journey). Nothing in these Terms shall limit or exclude easyCar's liability for fraudulent misrepresentation, for death or personal injury resulting from easyCar's negligence or for any other liability that cannot be limited or excluded by law.
    6. Each Member agrees (to the furthest extent allowed by law) to release, defend, indemnify, and hold easyCar and its affiliates and subsidiaries, and their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, that Member might have arising out of or in any way connected with:
      1. the Member's access to or use of the Site or the Services the subject of these Terms;
      2. the Member's violation of these Terms;
      3. the Member's:
        1. interaction with any other Member;
        2. Booking(s);
        3. creation of a Journey posting;
        4. use or condition of a vehicle;
      4. any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of a Booking or a Journey.
    7. Each Member (the "Indemnifying Member") agrees to release, defend, indemnify, and hold easyCar and its affiliates and subsidiaries, and their officers, directors, employees and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with a claim against easyCar by a third party (including another Member) resulting from:
      1. the Indemnifying Member's access to or use of the Site or the Services the subject of these Terms;
      2. the Indemnifying Member's violation of these Terms;
      3. the Indemnifying Member's:
        1. interaction with any other Member;
        2. Booking(s);
        3. creation of a Journey posting;
        4. use or condition of a vehicle;
      4. any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of a Booking or a Journey.
    8. easyCar will not be liable in respect of any damage to or theft or breakdown of any vehicle (or any contents of that vehicle) or failure by a Driver to complete a journey, or any related costs, including but not limited to loss of income or loss of use, and whether directly or indirectly incurred by a Member or any other party.
    9. easyCar is not a party to the agreement between the Driver and the Passenger, and easyCar does not have any control over, and is not responsible for, the actions or conduct of either the Driver or the Passenger in relation to that agreement.
  13. INTELLECTUAL PROPERTY

    1. The Site contains copyright material, trade marks, and other proprietary information, all of which is individually and collectively protected by copyrights laws and other intellectual property laws in the United Kingdom and internationally. Except as part of the intended use of the Site, a Site user must not copy, distribute, make available, publicly perform, display or create any work based on such content, or exploit such content in any way, in whole or in part. Except for content provided by Members, all of the content presented through the Site is owned by easyCar and its licensors. All rights are hereby expressly reserved.
    2. By making available any Member Content on or through the Site, that Member grants easyCar a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, use, view, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such Member Content on, through, or by means of the Site, easyCar social media properties, and other channels. easyCar does not claim any ownership rights in any such Member Content and nothing in these Terms will be deemed to restrict any rights that the Member may have to use and exploit any such Member Content.
    3. The Member agrees that he or she is solely responsible for all Member Content that he or she makes available through the Site and represents and warrants that:
      1. he or she either is the sole and exclusive owner of all such Member Content or has all rights, licenses, consents and releases that are necessary to grant to easyCar the rights in such Member Content, as contemplated in these Terms; and
      2. the use by the Member or easyCar of that Member Content will not infringe, misappropriate or violate a third party's patent, copyright, trademark, trade secret, moral rights or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.
    4. The Member recognises and accepts that easyCar reserves the right not to publish or to delete any review, any question, any comment or any response made or posted by a Member on or through the Site if it deems its content breaches these Terms, or for any other reason which easyCar, in its sole discretion, determines.

The Site may provide links to other websites for information. easyCar has not reviewed these third party websites and has no control over such sites or resources. easyCar does not endorse or make any warranties or representations about them, or any material found there, or any results that may be obtained from using such sites.
  14. GOVERNING LAW

    1. These Terms shall be governed by and construed in accordance with English law and each party agrees to submit any dispute in relation to these Terms (whether contractual or non-contractual) to the exclusive jurisdiction of the courts of England.
  15. GENERAL

    1. Any notice or other communication given to easyCar in connection with these Terms should be sent by email to carpool@easycar.com or by post to easyCar Pool Member Services, 3rd Floor Rear, Satila House, 109-111 Farringdon Road, London, EC1R 3BW.
    2. The invalidity, unenforceability or illegality of any provision (or part of a provision) of these Terms shall not affect the validity, enforceability or legality of the other provisions. If any invalid, unenforceable or illegal provision would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with whatever modification is necessary to give effect to the commercial intention of the parties.
    3. Any delay or failure to exercise any right or remedy under these Terms shall not be construed as a waiver of that right or remedy or any other right or remedy, and no partial or single exercise of a right or remedy under these Terms will prevent any further exercise of that right or remedy or any other right or remedy.
    4. These Terms are for the benefit of easyCar and the Members and no third party shall have the right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of these Terms but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
  16. Promotional T&Cs


    Share 3 Journeys Offer
    1. This offer (the "Scheme") enables participants (the "Members") to qualify for a bonus payment subject to these conditions.
    2. If the terms of the Scheme are satisfied, easyCar Pool will issue a £20 bonus (the "Bonus").
    3. The Bonus will take the form of a payment to the Member in easyCar Pool's next payment run.
    4. For the Bonus to be paid, the Member must accept through easyCar Pool at least one passenger booking on three separate rides of no less than 3 miles before 30th November 2017 and complete these rides before 31st December 2017 (each such completed ride being a "Qualifying Ride").
    5. easyCar will issue any properly accrued Bonus within 14 days of the completion of the third Qualifying Ride.
    6. The Scheme is intended for use by Members to post genuine journeys that they are planning to undertake, and for which they are willing to offer passengers up to 3 seats in their car, for a pre-determined compensation.
    7. easyCar Pool in its sole discretion may cancel any Bonus if in any doubt that Scheme rules have been fulfilled or withhold until satisfied that Qualifying Rides are genuine peer-to-peer use of the easyCar Pool platform.
    8. Only one bonus per Member is payable under this Scheme.
    9. easyCar Pool, in its sole discretion, reserves the right to make any necessary modifications to the Scheme and these rules at any time. All changes will be effective when made available in these rules as notified either by email or on easyCar Pool's website.
    10. By posting rides to easyCar Pool under the Scheme, you are agreeing to abide by these rules.

    Passenger Discount Offer
    1. Any easyCar Pool member (a "Member") in good standing can participate in the easyCar Pool discount offer scheme (the "Scheme").
    2. If the terms of the Scheme are satisfied, easyCar Pool will deduct the advertised amount from the cost of any ride booked on the easyCar Pool platform (the "Discount"). If the total cost of the ride is less than the advertised amount, the ride will be free of charge, but the Member will not be eligible for any remaining difference.
    3. To receive the Discount, a Member must book at least one seat on a listed ride before 31/12/2017, and with departure date before 31/1/2018, quoting the advertised discount code.
    4. The Scheme is intended for use by Members to book seats on genuine rides that they are planning to undertake.
    5. The Discount will apply solely for a Member's first booking.
    6. easyCar in its sole discretion, reserves the right to make any necessary modifications to the Scheme and these rules at any time. All changes will be effective when made available in these rules.
    7. By booking rides on easyCar Pool under the Scheme, you are agreeing to abide by these rules.

    Green Park Driver Offer
    1. This offer (the "Scheme") allows participants (the "Members") to qualify for a one-time £10 bonus subject to these conditions.
    2. If the terms of the Scheme are satisfied, easyCar Pool will issue a £10 bonus to the Member (the "Bonus").
    3. The Bonus will take the form of a payment to the Member in easyCar Pool's next payment run.
    4. For the Bonus to be paid, the Member must post at least 3 journeys of no less than 5 miles, with an origin or destination in one the following postcode areas: RG6, RG2, RG30, RG7 before 31st November 2017 ("Qualifying Rides").
    5. easyCar Pool in its sole discretion may cancel any Bonus if in any doubt that Scheme rules have been fulfilled or withhold until satisfied that Qualifying Rides are genuine peer-to-peer use of the easyCar Pool platform.

    3. The Bonus will take the form of a payment to the Member in easyCar Pool's next payment run.
    4. For the Bonus to be paid, the Member must accept through easyCar Pool at least one passenger booking a ride of no less than 5 miles between 1st November 2017 and 15th January 2018 and complete the ride before 31st January 2018 ("Qualifying Ride").
